Terms of Service

1. Who can use BeforeNow

You must be at least 13 years old, or the minimum age of digital consent where you live if that is higher, and able to form a binding contract. If you use BeforeNow on behalf of an organization, you confirm you are authorized to accept these terms for it.

2. Your account

You are responsible for your account and for keeping your password secure. Give us accurate information, and let us know promptly if you suspect unauthorized use. You are responsible for activity that happens under your account.

3. The service

BeforeNow turns the photos and videos you record or upload into short before and now Reels. Our systems transcribe your clips, select moments, add captions, music, and voice, and render a finished video. Features may change, improve, or be discontinued over time.

4. Your content and the license you grant us

You keep ownership of the photos, videos, and audio you upload and the Reels we produce for you. To provide the service, you grant BeforeNow a limited, worldwide, non-exclusive license to host, store, process, adapt, and display your content, and to share it with the service providers who help produce your Reels, solely for the purpose of operating and improving the service for you. This license lasts only as long as we hold your content, and it ends when you delete the content or your account, apart from copies that may remain briefly in routine backups. We do not use your content to advertise to others or sell it.

5. What you are responsible for

You agree that:

• You have the rights to the content you upload, including permission from anyone who appears or speaks in it.
• You will only clone or generate a voice that is your own, or one you have explicit permission to use.
• You will not upload content that is illegal, infringing, hateful, harassing, sexually exploitative, or that impersonates someone or misrepresents a real event in a harmful or deceptive way.
• You will not misuse the service, including by attempting to break, overload, reverse engineer, or gain unauthorized access to it, or by using it to build a competing product.

We may remove content or suspend accounts that violate these terms, and we may report unlawful activity to the authorities.

6. AI-assisted editing

BeforeNow uses AI to edit the story from your real footage. It selects and arranges what you actually filmed and said. It does not invent people you did not film or words you did not say. Automated editing is not perfect: review each Reel before you share it, because you are responsible for what you publish.

7. Subscriptions, billing, and cancellation

BeforeNow offers a free tier and a paid subscription, BeforeNow Pro. Pro is sold through the Apple App Store or Google Play and is subject to their terms as well as these. Key points:

• The price and billing period are shown in the app before you buy. Payment is charged to your Apple or Google account at confirmation.
• Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends.
• You manage or cancel a subscription in your Apple or Google account settings, not in the app.
• Any free trial converts to a paid subscription unless you cancel before it ends.
• Refunds are handled by Apple or Google under their policies. We generally cannot grant refunds directly.
• We may change prices or features. If a change affects your subscription, we will give notice as required, and it will apply from your next billing period.

8. Our intellectual property

The BeforeNow app, website, brand, and software are owned by us and protected by law. These terms do not give you any right to our name or logos. If you send us feedback, you allow us to use it to improve the service without obligation to you.

9. Termination

You can stop using BeforeNow and delete your account at any time. We may suspend or end your access if you violate these terms or use the service in a way that could harm BeforeNow or others. Sections that by their nature should survive termination will continue to apply.

10. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error free, or that a Reel will meet your expectations.

11. Limitation of liability

To the fullest extent permitted by law, BeforeNow will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 100. Some places do not allow these limits, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold BeforeNow harmless from claims and costs arising out of the content you upload or your misuse of the service, to the extent permitted by law.

13. Governing law and disputes

These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law rules. You agree that disputes will be resolved in the courts located there, unless a mandatory consumer law in your country gives you the right to bring a claim elsewhere.

14. Apple App Store

If you download BeforeNow from the Apple App Store, these terms are between you and BeforeNow, not Apple, and Apple is not responsible for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Your use must also comply with the App Store Terms of Service.

15. Changes to these terms

We may update these terms as the service changes. We will revise the date above and, for significant changes, give more prominent notice. Continuing to use BeforeNow after an update means you accept the revised terms.
